In short
Hostavern is run by Applied Ego Software LLC. You rent game servers by subscription: they renew until you cancel, cancelling runs to the end of what you’ve paid for, and payments aren’t refunded.
Your worlds stay yours. We back them up daily, but keep your own copies too. Use servers for games, follow Minecraft’s EULA, and don’t use them to hurt anyone or anything.
This summary is to help you read what follows; the full text below is what applies.
1.Who we are and this agreement
Hostavern is a trade name of Applied Ego Software LLC, a Missouri limited liability company (“Hostavern”, “we”, “us”). These Terms of Service are an agreement between you and us. They cover our website, the dashboard at app.hostavern.com, the game servers you rent from us, and anything else we provide (together, the “Service”).
By creating an account, ordering a server, or using the Service, you agree to these terms and to our Privacy Policy. If you’re agreeing for a company or other group, you confirm you can bind it to these terms. If you don’t agree, don’t use the Service.
2.Your account
You must be at least 13 years old to have an account. To pay for anything, you must be 18 or over, or have a parent or guardian’s permission, and they agree to these terms for you.
Give us accurate details and keep them up to date, especially your email, which is how you sign in and how we reach you. You’re responsible for keeping your sign-in details safe and for everything done through your account. Tell us at hello@hostavern.com straight away if you think someone else has got in.
A server’s owner can invite other people to help run it, as co-owners, moderators or members. The owner is responsible for what the people they invite do with the server, and for removing them when they should no longer have access.
3.What we provide
Each server is a container on one of our machines, with the memory, storage and CPU tier of the plan you pick. Machines are shared: every server shares CPU on equal terms, and higher CPU tiers set cores aside for you, but no server gets priority over another customer’s.
We work to keep servers running and reachable, but we don’t promise any particular uptime, and the Service may be interrupted for maintenance, updates, failures or things outside our control. We may move your server to another machine, which can change its address, and we’ll keep its files when we do.
We improve the Service over time, so features, software versions and the add-ons we offer may change, and some may be removed. If we stop offering the Service entirely, we’ll give you reasonable notice and a chance to download your files.
4.Games, mods and other people's terms
Minecraft is a trademark of Mojang AB. Hostavern isn’t made by, endorsed by or tied to Mojang or Microsoft. Running a Minecraft server means agreeing to the Minecraft EULA, and you’re responsible for following it and Mojang’s usage guidelines, including their rules on charging players.
Mods, plugins and modpacks are made by other people and come from Modrinth under their own licences. We don’t make them and can’t vouch for them. Whatever you install, you’re responsible for having the right to use it and for what it does to your server.
5.Payment, renewal and cancelling
Each server is its own subscription. You pay in advance for the term you pick (monthly, or a longer term at a discount), and it renews automatically at the end of each term, charged to your saved payment method, until you cancel. Prices are in US dollars and are shown before you pay; tax is added where it applies. Payments are handled by Stripe, and card details go to Stripe, not to us.
Cancelling. You can cancel any time from your server’s Billing page. The server keeps running until the end of the term you’ve paid for, then it stops renewing.
No refunds. Payments aren’t refunded, in whole or in part, including for the unused part of a term when you cancel, delete a server, or hand it to someone else. Moving to a bigger plan or CPU tier charges the difference for the rest of the term straight away; moving to a smaller one leaves a credit that comes off your next payments, not a refund. If we charge you by mistake, we’ll put it right. Nothing here takes away rights you have under the law where you live that can’t be waived.
Price changes. We may change our prices. A new price applies to new orders; if we change what an existing subscription pays, we’ll email you at least 30 days before it takes effect, and you can cancel before then.
Failed payments. If a payment fails, your server keeps running while we try again and you can update your card. If the subscription ends or stays unpaid, the server is suspended and stopped, but its files are kept. You can renew to start it again. We keep a suspended server’s files for at least 30 days; after that we may delete them.
Disputes. If you think a charge is wrong, email us first at hello@hostavern.com. If you dispute a payment with your bank instead, we may suspend the server while the dispute is open.
6.Handing a server over
An owner can offer their server to one of its co-owners. When the co-owner accepts and puts the subscription on their own payment method, they become the owner and are charged from the end of the term the previous owner paid for. The previous owner stays on as a co-owner, and their own subscription ends without a refund. Until the new owner accepts, nothing changes.
7.Your worlds and files
What you put on your server (worlds, builds, files, settings, and what your players make) stays yours. You give us permission to store, run, copy and back it up as needed to provide the Service, and for nothing else.
We back up every server daily and keep each daily backup for 7 days, and you can keep a few more by hand. Backups are taken in good faith but aren’t guaranteed: they can fail or be incomplete. Keep your own copies of anything you can’t afford to lose; you can download your files and backups from the dashboard.
When you delete a server, its files and its backups are deleted, and that can’t be undone.
8.Acceptable use
Servers are for running games. You agree not to use the Service, or let anyone use your server, to:
- break the law, or store or share anything illegal, including any sexual content involving minors;
- harass, threaten or exploit people, or encourage others to;
- infringe anyone’s copyright, trademark or other rights;
- attack, scan or overload other systems, including denial-of-service attacks, or run botnets, proxies, VPNs or anything else unrelated to running the game;
- mine cryptocurrency, or run work that uses a machine’s resources in ways that harm other customers;
- send spam, or phish, impersonate others, or mislead players, including through a server’s name or message;
- get around the limits of your plan, or get into servers, accounts or parts of our systems that aren’t yours;
- resell or sublet the Service without our written permission.
If we believe a server breaks these rules, we may stop it, suspend it or remove the content, and, for serious or repeated breaches, close the account. Where we reasonably can, we’ll tell you first and give you a chance to fix it. Payments aren’t refunded when we act on a breach.
9.Copyright complaints
If you believe something on a server we host infringes your copyright, email hello@hostavern.com with: what the work is; where it is on our Service (the server’s address or name); your contact details; a statement that you believe in good faith the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorized to act for them; and your signature. We’ll look into it, may remove the material, and will let the server’s owner know. We close the accounts of people who repeatedly infringe.
10.Ending this agreement
You can stop using the Service at any time by cancelling or deleting your servers; to close your account entirely, email hello@hostavern.com. We may suspend or end your access if you break these terms, if we’re required to by law, or if your use puts the Service or other customers at risk. If we end the Service for you without any fault of yours, we’ll give you a chance to download your files first. The sections on payment, your files, disclaimers, liability and disputes keep applying after this agreement ends.
11.Disclaimers
The Service is provided “as is” and “as available”. As far as the law allows, we make no promises beyond those written in these terms, including any implied promise that the Service is fit for a particular purpose, uninterrupted, error-free, or that data will never be lost.
12.Limits on our liability
As far as the law allows, we aren’t liable for indirect or consequential losses, or for lost profits, revenue, data, worlds or goodwill, even if we were told they might happen.
As far as the law allows, our total liability for any claim about the Service is limited to the amount you paid us for the server concerned in the 3 months before the event that gave rise to the claim.
You agree to cover our reasonable costs from claims by others that arise from what you put on your server or how you or your server’s members use the Service in breach of these terms.
Some places don’t allow some of these limits; where that’s so, they apply only as far as the law there allows.
13.Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters to you, we’ll email you before it takes effect. Keeping on using the Service after that means you accept the new terms; if you don’t, cancel before they take effect.
14.Law, disputes and the rest
These terms are governed by the laws of the State of Missouri and of the United States, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts located in Missouri, and you and we agree to their jurisdiction. If you’re a consumer, you keep any protections the law where you live gives you that can’t be overridden.
We may hand this agreement to another company that takes over the Service, including one we form to run Hostavern; you’ll keep the same rights under it. You can’t transfer your account to someone else, except by handing a server over as described above.
If part of these terms can’t be enforced, the rest still applies. If we don’t enforce something straight away, we haven’t given up the right to. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
